Tracing is bad, but this is based on referencing a pose.
No one can own a pose, regardless of how dynamic it is. If the anatomy of the creature drawn allows that movement, it is not unique, it is not special. It's an everyday movement that is not able to be claimed. If someone ever comes around screeching pose copying.. well..
